These Terms of Use ("Terms") govern your access to and use of hpovconsulting.com (the "Site"), operated by Holistic POV Consulting, LLC ("HPOV"). By accessing or using the Site, you agree to these Terms.

1. Informational Use Only

The Site is provided for informational purposes. Content does not constitute legal, financial, tax, accounting, or other professional advice and should not be relied upon as such. An advisory relationship with HPOV is formed only by a signed written engagement letter.

2. Intellectual Property

All content on the Site — including text, graphics, the HPOV signature and hummingbird mark, photography, and software — is owned by or licensed to HPOV and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

3. Submissions and Application Materials

By submitting an inquiry, message, resume, or cover letter, you represent that the content is truthful, is yours to share, and does not infringe any third-party rights. You grant HPOV a limited license to store, review, and process the submission for the purposes described in our Privacy Policy.

4. Messaging Terms (TCPA)

If you provide a phone number and check the TCPA consent box on our contact form, you give prior express written consent to be contacted by HPOV at that number, including by autodialed or prerecorded/ artificial-voice calls and SMS/MMS text messages, for purposes related to your inquiry. Message and data rates may apply. Message frequency varies. Consent is not a condition of any service.

5. Acceptable Use

You agree not to:

• use the Site in violation of any applicable U.S. federal, state, or local law;

The Site is provided "as is" and "as available." HPOV disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

7. Limitation of Liability

To the fullest extent permitted by law, HPOV will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Site, even if advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold HPOV harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

9. Governing Law and Venue

These Terms are governed by the laws of the United States and the State in which HPOV maintains its principal place of business, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in that State, and you consent to personal jurisdiction and venue there.

We may revise these Terms at any time by posting an updated version. Continued use of the Site after changes constitutes acceptance.
